Federal Hemp ban and the effects on Virginia patients

Federal Hemp Ban & Your Virginia Medical Cannabis Options

The federal government recently announced plans to prohibit most hemp-derived products. While this plan is still under review, the proposal has wide-reaching implications for patients nationwide. Many patients have questions. Let’s review what we know so far.

1. What is the new federal hemp ban?

Congress recently passed legislation that tightens the rules for hemp-derived THC products (such as Delta-8, Delta-10, THC-O, and many others). Under the new law, any hemp product that contains intoxicating levels of THC — including THC isomers — is no longer considered federally legal.
This means many of the gummies, vapes, and tinctures that have been widely sold in gas stations, vape shops, and online may soon be removed from the market.

2. Are hemp products illegal now?

Many of the intoxicating hemp products will become federally illegal to manufacture, ship, or sell once the law takes effect.
The exact timing of enforcement may vary, and some states are adjusting their own rules quickly. You should expect many commonly available hemp-THC items to disappear from stores, probably by November.

3. Does this affect CBD?

Non-intoxicating CBD products are still legal as long as they meet federal requirements and contain less than 0.3% total THC by dry weight.
However, some retailers may pull more products from shelves out of caution.

4. Will I still be able to buy THC products in Virginia?

Yes — state-regulated medical cannabis products remain legal in Virginia.
You can continue purchasing THC products from licensed Virginia dispensaries as long as you have a valid medical cannabis certification from a qualified practitioner.

These dispensaries are regulated, tested for safety, and offer reliable product quality — unlike many of the hemp-derived items that are now banned.

5. How does this federal change affect the Virginia medical cannabis program?

It doesn’t.
Virginia’s medical cannabis laws remain in place, and dispensaries will continue operating under the Virginia Cannabis Control Authority.
The new federal rules only affect unregulated hemp-derived THC products, not the state medical program.

6. Why are so many people turning to the medical program now?

With hemp-derived THC products becoming illegal or unavailable, patients who have relied on them for pain, sleep, anxiety, or other symptoms now need a safe, legal, and consistent way to access THC.
The medical program offers:

  • Reliable product testing and dosing
  • Medical guidance
  • Legal protections for possession and use
  • Access to forms of THC that are safer and more effective than many hemp-derived alternatives

7. Is it harder to get certified now?

No — the process in Virginia is still simple.
At ReThink-Rx, you meet with a licensed cannabis-trained practitioner through telehealth or in person. If you qualify, you receive a written certification that allows you to purchase products from state-licensed dispensaries the same day.

8. Will getting certified protect me legally?

Yes.
Patients with a valid medical cannabis certification are legally allowed to possess and use medical cannabis products purchased from licensed Virginia dispensaries. In addition, certification provides protection for most jobs and in other legal matters.
The recent federal hemp ban does not change these state protections.

9. Will adult-use (recreational) sales help replace hemp products?

Virginia allows adult possession and home grow, but retail recreational sales have not yet begun.
Until the retail market launches, the medical program remains the only legal and reliable way to purchase THC products in Virginia.

10. I used Delta-8 or hemp gummies. What should I do now?

If you used hemp-derived Delta-8 THC for symptom relief, now is a good time to switch to the regulated medical program.
Medical products offer:

  • Safer dosing
  • Clear labeling
  • Tested, safe products
  • More consistent product content
  • Better symptom control
  • Stronger legal protection
  • Physician guidance tailored to your health needs

ReThink-Rx can help you transition safely and comfortably.

11. Will the products in the dispensaries feel the same as what I’ve been using?

Generally, yes — and often better.
Medical dispensaries offer a full range of THC and CBD options (capsules, tinctures, edibles, vapes, topicals, and more) with accurate dosing and predictable effects.
Your provider can help you match or improve the effects you used to get from hemp products.

12. Do I need to stop using hemp products immediately?

If you still have hemp-derived THC at home, you’re unlikely to face immediate penalties, but buying or shipping new products may soon become risky.
For safety and legality, you should shift to state-regulated medical cannabis products as soon as you are able.

13. How do I keep my certification active?

Your certification must be renewed annually. ReThink-Rx will send reminders and can complete your renewal quickly through telehealth.

14. Where can I get help or ask questions?

You can contact ReThink-Rx anytime. We’re here to guide you through the transition, explain the new laws, and help you choose the right medical cannabis products for your needs.
